1. About These Terms
These Terms of Service ("Terms") govern access to and use of PingPolls (the "Service"), operated by PT Internet Respons Lab ("PingPolls," "we," "us," or "our"). The Service lets account holders ("Form Creators") create and publish forms, collaborate with team members, collect responses, analyze results, and use available AI, file, integration, and authorization features. Individuals who answer forms are "Respondents."
By using the Service, you agree to these Terms and our Privacy Policy. If you use the Service for an organization, you represent that you may accept these Terms on its behalf. If you do not agree, do not use the Service.
2. Accounts, Teams, and Security
You must provide accurate account information and protect your authentication methods. You are responsible for activity under your account and for promptly notifying us of suspected unauthorized access. We may require additional authentication, including multi-factor authentication, for sensitive actions.
Accounts may create or join teams and receive invitations or roles. Team owners and administrators are responsible for managing membership and access. Users may authorize OAuth clients or integrations to access a team or resource with selected permissions; review the client and requested access before consenting, and revoke authorizations you no longer need.
3. Form Creators and Respondents
Form Creators are responsible for their forms, questions, settings, distribution, and use of information collected through them. You must provide required privacy notices, obtain permissions and lawful bases, and honor applicable rights requests. Do not collect information you do not need or highly sensitive information such as passwords, payment card data, or bank-account credentials.
Form Creators must not use the Service for unlawful, deceptive, discriminatory, harassing, or fraudulent activity; to infringe another party's rights; to distribute malware or harmful material; to interfere with Service security or availability; or to access data or accounts without authorization. Respondents should review the form and its creator's notices before submitting information and should not include secrets in responses.
4. Your Content and Permission to Operate the Service
As between you and PingPolls, you retain your rights in content you submit or create, subject to rights held by Respondents and other third parties. You grant PingPolls a worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, display, modify as technically necessary, and otherwise process that content to provide, secure, maintain, and improve the Service, including storage, collaboration, search, AI features you invoke, and integrations you configure. This permission ends when the content is deleted from the Service, except for copies retained in backups or records as described in the Privacy Policy or as required by law.
You represent that you have the rights and permissions needed to submit the content and grant this license. PingPolls owns the Service, software, branding, and related materials. These Terms do not transfer ownership of user content or grant a right to copy, reverse engineer, or commercially exploit the Service except where applicable law permits or we authorize it in writing. Any Certiscore™ methodology attribution requirements are described in the applicable published materials; no claim in these Terms expands intellectual-property rights beyond those materials and applicable law.
5. AI, Voice, and Integrations
Available AI features may assist with form creation/editing, response analysis, retrieval, or search. When you choose to use an AI feature, relevant prompts, form content, response context, or eligible uploaded-file content may be processed by third-party AI providers, including Google Gemini, OpenAI, or Cloudflare Workers AI, depending on the feature and current configuration. AI-generated output can be incomplete, inaccurate, or unsuitable. You are responsible for reviewing it before use and for ensuring you have permission to submit the relevant information to the provider. PingPolls does not use Respondent data to train its own general-purpose models.
Voice input may rely on browser or device speech-recognition technology; availability and processing can vary by platform. You are responsible for reviewing applicable browser/device terms and informing Respondents where appropriate.
Integrations and OAuth clients act on data and permissions you select. When you connect a third-party service or authorize a client, its use of received data is governed by its own terms and privacy practices. PingPolls is not responsible for third-party services, their availability, or their handling of data after transfer. Disconnect integrations and revoke OAuth access when no longer needed.
6. Privacy, Storage, and Retention
Our Privacy Policy describes our processing, providers, cookies, security practices, exports, and deletion processes. Data may be hosted or processed in Indonesia, the United States, and provider locations. We use reasonable technical and organizational measures but cannot guarantee absolute security or uninterrupted availability.
Form Creators may configure response retention where the feature and plan support it. Deletion and retention actions may be carried out by background jobs and storage lifecycle processing, so completion may take additional time. Account deletion may be unavailable while an active subscription exists and may depend on successful cleanup of PingPolls-managed objects and provider contacts. Provider-side or legally required records may remain under the provider's policies or applicable law.
7. Plans, Payments, and Cancellation
Paid plans, features, prices, and limits are described at checkout or in the Service and may change prospectively. Dodo Payments acts as our Merchant of Record and handles checkout, payment processing, billing records, taxes, and subscription management. Dodo's terms and policies also apply to those transactions. PingPolls maintains only the local subscription and payment linkage needed to operate the Service.
Access to paid features depends on the subscription and payment state confirmed to PingPolls. You may manage or cancel a subscription through the available billing portal. Unless checkout or applicable law states otherwise, cancellation stops renewal and paid access continues through the period already paid for. Failed payments may cause paid features to be suspended until payment is resolved.
Refunds, proration, credits, taxes, plan changes, and other transaction-specific terms are shown in the applicable checkout flow or Dodo customer portal and are subject to applicable law and Dodo's policies. Contact Dodo Payments for payment records or transaction handling; contact PingPolls for the Service access associated with a subscription.
8. Availability, Suspension, and Termination
We may modify, suspend, or discontinue features to maintain or improve the Service. We may restrict or suspend access where reasonably necessary to protect users, investigate abuse or security issues, comply with law, address non-payment, or respond to a breach of these Terms. Where practicable, we will provide notice and an opportunity to address the issue.
You may stop using the Service and may request account deletion through the available account controls, subject to the eligibility and cleanup conditions in the Privacy Policy. Provisions that by their nature should continue after termination, including provisions on ownership, accrued payment obligations, disclaimers, and liability, will survive.
9. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties, conditions, or guarantees, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs or analytics will be accurate or complete.
To the maximum extent permitted by law, PT Internet Respons Lab and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from or related to the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits rights that cannot lawfully be limited.
10. Governing Law and Changes
These Terms are governed by the laws of Indonesia, without regard to conflict-of-law rules, subject to mandatory consumer protections that apply to you. Disputes are subject to the competent courts in Jakarta, Indonesia, except where applicable law requires another forum.
We may update these Terms as the Service changes. We will provide reasonable notice of material changes, which may include email or in-product notice. Updated Terms apply from their stated effective date. Continued use after that date indicates acceptance where permitted by law.
